With Comcast, the largest cable VoIP service provider of USA and Missouri Public Service Commission (MPSC) heading towards a legal battle, the debate regarding the determination of state jurisdiction over regulating the activities of VoIP service providers has come into the fore in America.

According to this report, Comcast has filed a suit against the Missouri regulators in U.S. District Court in Kansas City, demanding the court to obstruct the state from seeking regulation of its Internet-based phone service.

The complain came following the objection from the MPSC that Comcast is selling local and long-distance phone service in the Kansas City area without the proper state approvals.

The suit explains that the FCC (Federal Communications Commission) is still reviewing the issue. It also sites an early FCC decision, which preempted the Minnesota Public Utilities Commission from exercising authority over Vonage. Hence, it is high time now for the FCC to frame a law that would define the state’s jurisdictions over regulating VoIP services.
